label=\"图片备注\">推特创始人多尔西发布推文道歉,图源:推特</p><p>出乎意料的是,身处暴风眼的马斯克对此也倍感委屈。马斯克在推文中写道,对于一个每天亏损四百万美元的公司而言,除了裁员别无选择。</p><p>在马斯克的眼中,对于此次裁员,推特已经仁至义尽。<strong>“每个离开的人都得到了3个月的遣散费,这比法律要求的高出50%。”</strong>似乎每个员工还因为裁员意外发了一笔财。但事实真的如此吗?</p><p label=\"大标题\">一、硅谷步入“动荡的新时期”</p><p>美国财经电视CNBC报道称,此前为尽快推行蓝V订阅付费制,在没有明确加班费的情况下,推特的管理人员一度要求一些员工每周工作7天,每天工作12小时。更有员工在社交媒体晒出了裹着睡袋睡在特推办公室的照片。</p><p>不过,即使拼命加班赶工,50%的推特员工依然逃脱不了被裁的命运。“今天上班基本都是哭声一片,”一名推特员工在11月2日的推文中写道,“没有人知道下一步,没有人知道干什么。”</p><p><img label=\"备注\">(Facebook改名而来)</span>的CEO扎克伯格11月8日也宣布了自己的裁员计划,“我已决定将我们团队的规模缩减约13%,并让超过11000名有才华的员工离职。”这场波及1.1万人的Meta成立18年以来首次大规模裁员,甚至被媒体称作“美国科技行业最大规模裁员”。</p><p>而根据业内人士预测,押宝元宇宙的Meta未来也并不乐观,Meta这场裁员风波可能只是开始。</p><p>事实上,裁员寒意已经蔓延到互联网、自动驾驶、半导体、人工智能等多个领域。借用《<a href=\"https://laohu8.com/S/WPO\">华盛顿邮报</a>》的说法,裁员潮之下硅谷已经进入了一个“动荡的新时期”<span label=\"备注\">(a tumultuous new period)</span>。</p><p>早在10月,<a href=\"https://laohu8.com/S/MSFT\">微软</a>便声称将裁员近千人,涉及Xbox和Edge等部门。10月底,<a href=\"https://laohu8.com/S/INTC\">英特尔</a>CEO帕特·盖尔辛格也已确认,公司将对全球启动大规模、“有针对性”的裁员,涉及销售、市场等部门。</p><p>除此之外,网约车巨头Lyft和支付公司Stripe也都宣布了裁员计划。其中,前者裁员比例为13%,而后者则相对略高,为14%。</p><p>这场裁员浪潮不仅惊动了硅谷,也震惊了世界。“硅谷寒冬”“硅谷凛冬”“裁员血洗硅谷”……中文互联网上,媒体也纷纷传达出对于大洋彼岸裁员潮乍起的惊讶。</p><p>不过,在这场几乎可以称得上是覆巢之灾的大事件背后,与裁员公司的数量和公司的裁员比例相比,一个硅谷员工在何种情况下能够拿到裁员赔偿,以及被裁以后究竟能够拿到多少赔偿的问题,也同样值得关注。</p><p label=\"大标题\">二、美国没有《劳动法》,所以不需要赔偿?</p><p>“美国没有劳动法”、“美国的劳动法全是假的”……硅谷裁员风波下自媒体掀起了对于美国的声讨。有激进者甚至提出,因为美国没有《劳动法》,所以公司裁员并无任何法律约束,也不需要承担任何责任。</p><p>确如自媒体们所言,美国确实没有一部可以囊括劳动领域各个方面的叫作《劳动法》的法律。<strong>但实际上,这并不意味着美国没有调整劳动关系的法律。</strong></p><p>一位劳动法专家告诉谷河青年,在我国,《劳动法》规范着劳动用工的诸多方面,《劳动合同法》更是对劳动关系调整、劳动者保护进行了详尽规定。而与我国不同,<strong>美国的“劳动法”则分散在《劳资关系法》《公平劳动标准法》《职业安全卫生法》等多法规中,分别规范着劳动领域的不同方面。</strong>更通俗地理解,<strong>美国没有一部叫作《劳动法》的法典,而确实拥有“劳动法”即拥有规范劳动领域的法律文件。</strong></p><p>此外,关于美国有没有劳动法的争论还涉及到翻译的问题。“劳动法”有广义与狭义之分:狭义的“劳动法”<span label=\"备注\">(labor law)</span>指代集体劳动关系法<span label=\"备注\">(调整劳动者团体与劳动者之间的关系)</span>,而广义的“劳动法”还包括个别劳动关系法<span label=\"备注\">( employment law,规范劳动者个人与雇主之间的关系)</span>。</p><p>前者在我国和部分欧洲国家往往被直译为《劳动法》<span label=\"备注\">(这里则既包括集体劳动关系法,也包括个别劳动关系法)</span>。由此产生了美国没有《劳动法》,而又有“劳动法”<span label=\"备注\">(集体劳动关系法)</span>的问题。事实上,对于由“labor law”翻译过来的《劳动法》,称之为集体劳动关系法或许更为贴切。</p><p label=\"大标题\">三、什么样的情况下可以拿到裁员赔偿?</p><p>上述专家表示,美国作为联邦制国家,先有州而后才有联邦,联邦的权力是州的让渡,让渡之外的权力则保留在州。换言之,联邦权力源于州,而高于州。同理,在立法方面,联邦层面的立法于州而言,既是参考,也是约束。</p><p>但就劳动领域立法来说,美国联邦层面虽然基于特定宪法条款而进行了一定程度的立法,但并不全面,更细致的规范仍保留在州层面。故而,<strong>此次硅谷裁员的赔偿问题还需要针对其所在州——加州的立法来作具体讨论。</strong></p><p>与美国大多数州一样,加州立法层面采取的是雇佣自由原则<span label=\"备注\">(AT WILL)</span>。这种原则下,雇用与解雇相当自由。无论雇主的解雇理由是否合理<span label=\"备注\">(雇主甚至可以不提出理由)</span>,雇主都可以自由解雇任何劳动者,除非雇主与劳动者另有约定或因特殊事项不得解雇。不过这也不意味着雇主可以为所欲为,他们还要受到三方面的限制:</p><ul><li><p>第一,公共政策<span label=\"备注\">(public policy)</span>,大致对应我国的公序良俗,有些州也把诚实信用原则、公平交易原则作为自由解雇的限制,如不能因为员工拒绝雇主违法指令而解雇;</p></li></ul><ul><li><p>第二,合同明确约定某些情况不得解雇;</p></li></ul><ul><li><p>第三,平等、反歧视等其他法律价值的限制,如不能因为性别、肤色、宗教因素而遭解雇。</p></li></ul><p>与上述情况不同,<strong>此次硅谷的裁员,并非上述的违约或者歧视裁员,而更多的是经济性裁员</strong><span label=\"备注\">(即因为经营不善而导致的裁员)</span>。涉及到经济性裁员,美国立法方面主要有联邦的《职工调整与再培训通知法》<span label=\"备注\">(Worker Adjustment and Retraining Notification Act,简称WARN法案)</span>作出了相关规定:要求雇主解雇员工需提前60天通知员工。如果不履行,应承担支付60天工资的责任,各州不低于该标准。这也就是马斯克为何说自己多支付了50%的原因——<strong>本来只需要支付60天,而他支付了90天。虽然,有媒体质疑这种计算方式忽略了员工应得的股权分红等,但马斯克的说辞也并非毫无道理。</strong></p><p><img label=\"图片备注\">《职工调整与再培训通知法》原文</p><p>此次硅谷裁员潮下,对于大部分被裁员工而言,WARN法案是他们为数不多的可以用以争取赔偿的法律武器。当然,这是建立在他们被裁而未被提前通知的前提下。从实际情况来看,根据彭博社此前的消息,他们<span label=\"备注\">(推特员工)</span>也正打算这么做。</p><p label=\"大标题\">四、一个被裁的硅谷员工能够拿到多少赔偿?</p><p>如上所述,按照WARN法案,如果员工没有被提前60天通知,那么雇主需要给予员工60天的工资作补偿。实际上,这也就是从立法层面为员工争取了60天的裁员赔偿。换句话说,一个被裁的硅谷员工通常能够拿到两个月的工资作为他的裁员补偿。</p><p>根据Joint Venture Silicon Valley发布的《2022年硅谷指数》<span label=\"备注\">(2022 Silicon Valley Index)</span>,2021年硅谷平均年收入<span label=\"备注\">(包括工资、薪水、奖金和股票期权)</span>为 17 万美元<span label=\"备注\">(合120.9万元人民币)</span>。据此推算,<strong>一个被裁的硅谷人大概能获得两三万美元</strong><span label=\"备注\">(约合15万元人民币)</span><strong>的裁员赔偿金。</strong></p><p>不过,硅谷公司也并非都按照WARN法案给出的60天工资标准兜底赔偿。甚至相较于马斯克的90天工资赔偿方案,许多公司开出的赔偿条件也更为优越。例如,前文所言及的Meta就规定:员工将获得4个月的基本工资遣散费,外加按入职年份追加的基本工资<span label=\"备注\">(每入职一年则多发半个月)</span>;公司将为员工及家人支付6个月的医疗保健费用,有薪假期将获得支付;被裁员工的限制性股票<span label=\"备注\">(RSU)</span>也将于11月15号支付。</p><p><img label=\"备注\">(约合70万元人民币)</span>。</p><p>另据《知危财经》的报道,一位在Meta工作两年的被裁员工声称自己因为裁员获得了高达13.7万美元<span label=\"备注\">(合97.4万元人民币)</span>的赔偿金。似乎,一个被裁的硅谷员工能够因为裁员而大赚一笔。</p><p>但根据《中国企业家》杂志此前的报道,这样的说法有些夸张。有被裁的Meta员工在接受采访时表示考虑到Meta这里的薪资与高昂的生活成本不成正比,此外当地交税比例也高达35%以上,实际上税后到手薪资并不可观,远低于传闻中的“天文”数字。不过,即使如此,不少网友也表示“赔得很到位”、“已经不错了”……</p><p><img tumultuous new period)。早在10月,微软便声称将裁员近千人,涉及Xbox和Edge等部门。10月底,英特尔CEO帕特·盖尔辛格也已确认,公司将对全球启动大规模、“有针对性”的裁员,涉及销售、市场等部门。除此之外,网约车巨头Lyft和支付公司Stripe也都宣布了裁员计划。其中,前者裁员比例为13%,而后者则相对略高,为14%。这场裁员浪潮不仅惊动了硅谷,也震惊了世界。“硅谷寒冬”“硅谷凛冬”“裁员血洗硅谷”……中文互联网上,媒体也纷纷传达出对于大洋彼岸裁员潮乍起的惊讶。不过,在这场几乎可以称得上是覆巢之灾的大事件背后,与裁员公司的数量和公司的裁员比例相比,一个硅谷员工在何种情况下能够拿到裁员赔偿,以及被裁以后究竟能够拿到多少赔偿的问题,也同样值得关注。二、美国没有《劳动法》,所以不需要赔偿?“美国没有劳动法”、“美国的劳动法全是假的”……硅谷裁员风波下自媒体掀起了对于美国的声讨。有激进者甚至提出,因为美国没有《劳动法》,所以公司裁员并无任何法律约束,也不需要承担任何责任。确如自媒体们所言,美国确实没有一部可以囊括劳动领域各个方面的叫作《劳动法》的法律。但实际上,这并不意味着美国没有调整劳动关系的法律。一位劳动法专家告诉谷河青年,在我国,《劳动法》规范着劳动用工的诸多方面,《劳动合同法》更是对劳动关系调整、劳动者保护进行了详尽规定。而与我国不同,美国的“劳动法”则分散在《劳资关系法》《公平劳动标准法》《职业安全卫生法》等多法规中,分别规范着劳动领域的不同方面。更通俗地理解,美国没有一部叫作《劳动法》的法典,而确实拥有“劳动法”即拥有规范劳动领域的法律文件。此外,关于美国有没有劳动法的争论还涉及到翻译的问题。“劳动法”有广义与狭义之分:狭义的“劳动法”(labor law)指代集体劳动关系法(调整劳动者团体与劳动者之间的关系),而广义的“劳动法”还包括个别劳动关系法( employment law,规范劳动者个人与雇主之间的关系)。前者在我国和部分欧洲国家往往被直译为《劳动法》(这里则既包括集体劳动关系法,也包括个别劳动关系法)。由此产生了美国没有《劳动法》,而又有“劳动法”(集体劳动关系法)的问题。事实上,对于由“labor law”翻译过来的《劳动法》,称之为集体劳动关系法或许更为贴切。三、什么样的情况下可以拿到裁员赔偿?上述专家表示,美国作为联邦制国家,先有州而后才有联邦,联邦的权力是州的让渡,让渡之外的权力则保留在州。换言之,联邦权力源于州,而高于州。同理,在立法方面,联邦层面的立法于州而言,既是参考,也是约束。但就劳动领域立法来说,美国联邦层面虽然基于特定宪法条款而进行了一定程度的立法,但并不全面,更细致的规范仍保留在州层面。故而,此次硅谷裁员的赔偿问题还需要针对其所在州——加州的立法来作具体讨论。与美国大多数州一样,加州立法层面采取的是雇佣自由原则(AT WILL)。这种原则下,雇用与解雇相当自由。无论雇主的解雇理由是否合理(雇主甚至可以不提出理由),雇主都可以自由解雇任何劳动者,除非雇主与劳动者另有约定或因特殊事项不得解雇。不过这也不意味着雇主可以为所欲为,他们还要受到三方面的限制:第一,公共政策(public policy),大致对应我国的公序良俗,有些州也把诚实信用原则、公平交易原则作为自由解雇的限制,如不能因为员工拒绝雇主违法指令而解雇;第二,合同明确约定某些情况不得解雇;第三,平等、反歧视等其他法律价值的限制,如不能因为性别、肤色、宗教因素而遭解雇。与上述情况不同,此次硅谷的裁员,并非上述的违约或者歧视裁员,而更多的是经济性裁员(即因为经营不善而导致的裁员)。涉及到经济性裁员,美国立法方面主要有联邦的《职工调整与再培训通知法》(Worker Adjustment and Retraining Notification Act,简称WARN法案)作出了相关规定:要求雇主解雇员工需提前60天通知员工。如果不履行,应承担支付60天工资的责任,各州不低于该标准。这也就是马斯克为何说自己多支付了50%的原因——本来只需要支付60天,而他支付了90天。虽然,有媒体质疑这种计算方式忽略了员工应得的股权分红等,但马斯克的说辞也并非毫无道理。《职工调整与再培训通知法》原文此次硅谷裁员潮下,对于大部分被裁员工而言,WARN法案是他们为数不多的可以用以争取赔偿的法律武器。当然,这是建立在他们被裁而未被提前通知的前提下。从实际情况来看,根据彭博社此前的消息,他们(推特员工)也正打算这么做。四、一个被裁的硅谷员工能够拿到多少赔偿?如上所述,按照WARN法案,如果员工没有被提前60天通知,那么雇主需要给予员工60天的工资作补偿。实际上,这也就是从立法层面为员工争取了60天的裁员赔偿。换句话说,一个被裁的硅谷员工通常能够拿到两个月的工资作为他的裁员补偿。根据Joint Venture Silicon Valley发布的《2022年硅谷指数》(2022 Silicon Valley Index),2021年硅谷平均年收入(包括工资、薪水、奖金和股票期权)为 17 万美元(合120.9万元人民币)。据此推算,一个被裁的硅谷人大概能获得两三万美元(约合15万元人民币)的裁员赔偿金。不过,硅谷公司也并非都按照WARN法案给出的60天工资标准兜底赔偿。甚至相较于马斯克的90天工资赔偿方案,许多公司开出的赔偿条件也更为优越。例如,前文所言及的Meta就规定:员工将获得4个月的基本工资遣散费,外加按入职年份追加的基本工资(每入职一年则多发半个月);公司将为员工及家人支付6个月的医疗保健费用,有薪假期将获得支付;被裁员工的限制性股票(RSU)也将于11月15号支付。Meta裁员赔偿规定原文Meta此前向美国证监会(SEC)提交的财务文件显示,2021年Meta的员工年薪中位数为29.28万美元(合208.2万元人民币)。这意味着平均标准下,一个被辞退的Meta员工仅基本工资遣散费一项就能拿到约9.76万美元(约合70万元人民币)。另据《知危财经》的报道,一位在Meta工作两年的被裁员工声称自己因为裁员获得了高达13.7万美元(合97.4万元人民币)的赔偿金。似乎,一个被裁的硅谷员工能够因为裁员而大赚一笔。但根据《中国企业家》杂志此前的报道,这样的说法有些夸张。有被裁的Meta员工在接受采访时表示考虑到Meta这里的薪资与高昂的生活成本不成正比,此外当地交税比例也高达35%以上,实际上税后到手薪资并不可观,远低于传闻中的“天文”数字。不过,即使如此,不少网友也表示“赔得很到位”、“已经不错了”……网友评论硅谷的裁员赔偿,图源:今日头条“我知道这对每个人来说都非常艰难,我对受到(此事)影响的人感到抱歉。”扎克伯格在Meta官网上的一封对员工的道歉信中写道。在这封道歉信中。扎克伯格检讨了自己的错误,并表示将给员工支付足够的补偿费用。不过,并非所有人都对扎克伯格的这番“真诚的”说辞表示买账。有被裁员工在接受《南方人物周刊》采访时便说,公司的错误不应该由员工来买单。或如其所言,比起讨论老板道歉和裁员补偿,裁员是否会继续这个问题似乎更令人关心。本文来自微信公众号:谷河青年
