Here, AT&T was combining video content creation with video program distribution; the allegation was that competitors in either segment might be hurt. Yet there are clear efficiencies to be had, as widely found in studies of vertically integrated firms, with joint operations boosting consumer happiness. Buyers at Costco eagerly snap up Costco-supplied Kirkland products—which the retailer stocks in place of those of some independent producers—if they improve price or quality. So facts, not just a story, are needed. District Court Judge Richard J. Leonfoundthat the DOJ case “falls far short of establishing the validity of its… theory.”</p>\n<p>Aside from the political overtones of the case, there was good historical reason to doubt the official complaint. July's worst-performing names among the <b>S&P 500</b> (SNPINDEX:^GSPC) constituents were <b>Las Vegas Sands</b> (NYSE:LVS), <b>Wynn Resorts</b> (NASDAQ:WYNN), <b>Norwegian Cruise Line Holdings</b> (NYSE:NCLH), and <b>Carnival Corporation</b> (NYSE:CCL). The commonality is clear. All are tourism plays, but more to the point right now, these companies have the most to lose if the recent increase in COVID-19 cases worsens. In this light, last month's steep sell-offs make a lot of sense.</p>\n<p>Veteran investors know the time to step into quality stocks is when they've been needlessly beaten down, but sometimes, stocks are upended for all the right reasons. It's not always easy to determine which is which, and this is one of those tricky times.</p>\n<p>Too late to stop it now</p>\n<p>The sell-offs last month were steep. Carnival shares fell 17.9% with rival Norwegian Cruise Line seeing its shares slide 18.3%. Wynn Resorts stock fell 19.6%, matching the loss logged by Las Vegas Sands. In all four cases, the selling simply extended pullbacks that first started taking shape in June.</p>\n<p><img src=\"https://static.tigerbbs.com/5f6d79db732cfe9fd24ea383f893ddc5\" tg-width=\"720\" tg-height=\"483\" referrerpolicy=\"no-referrer\"></p>\n<p>Data by YCharts.</p>\n<p>Now, investors face a key question: Will the growing number of global coronavirus cases exact the same toll taken in 2020, the first time the pandemic swept across the world?</p>\n<p>Nobody really knows. From an odds-making perspective, though, it would be naive to believe something like the strict shutdowns we saw last year aren't a possibility if the situation continues to worsen.</p>\n<p>The official guidance thus far is more hopeful. On Aug. 1, Dr. Anthony Fauci, Director of the U.S. National Institute of Allergy and Infectious Diseases, said the U.S. will not suffer lockdowns again, even though he believes the pandemic will indeed get worse in the U.S. before improving. Within the past month, lockdowns have been mandated in Australia, China, Mexico, and Canada, while France and other European countries are raising the bar on who is allowed to travel to, from, and within the country.</p>\n<p>And that's just a small sampling. This is not one of those times. July's worst-performing names among the S&P 500 (SNPINDEX:^GSPC) constituents were Las Vegas Sands (NYSE:LVS), Wynn Resorts (NASDAQ:WYNN), Norwegian Cruise Line Holdings (NYSE:NCLH), and Carnival Corporation (NYSE:CCL). The commonality is clear. All are tourism plays, but more to the point right now, these companies have the most to lose if the recent increase in COVID-19 cases worsens. In this light, last month's steep sell-offs make a lot of sense.\nVeteran investors know the time to step into quality stocks is when they've been needlessly beaten down, but sometimes, stocks are upended for all the right reasons. It's not always easy to determine which is which, and this is one of those tricky times.\nToo late to stop it now\nThe sell-offs last month were steep. Carnival shares fell 17.9% with rival Norwegian Cruise Line seeing its shares slide 18.3%. Wynn Resorts stock fell 19.6%, matching the loss logged by Las Vegas Sands. Shares of rival <a href=\"https://laohu8.com/S/F\">Ford</a> fell 5.0%.</p>\n<p>Nine of the 11 S&P indexes were lower, with industrials and energy both slipping, as data showed U.S. private payrolls increased far less than expected in July, likely constrained by shortages of workers and raw materials.</p>\n<p>The blue-chip Dow, heavily weighted toward economically-sensitive stocks, also declined.</p>\n<p>The technology-heavy Nasdaq bucked the trend after another report showed a measure of U.S. services industry activity jumped to a record high last month, suggesting a broader economic rebound was still on track.</p>\n<p>\"The ADP employment report this morning (is a) big miss ... has people really locked in on tomorrow's initial claims and then Friday's non-farm payrolls report,\" said Ross Mayfield, investment strategist at Baird in Louisville, Kentucky. \"To me that’s a big driver (of the market today).\"</p>\n<p>\"Broadly, the continued evolution of COVID-19, the Delta variant over the recent weeks and months kind of re-rating of the growth outlook\" has the market coming to terms with what it means for the reflation trade, and what it means to the bond market, Mayfield said.</p>\n<p>After six straight month of gains, the benchmark S&P 500 has struggled to rise in August over concerns about the pace of growth as the economy rebounded from the depths of the COVID-19-driven recession, and fears of higher inflation overshadowed a stellar corporate earnings season.</p>\n<p>Federal Reserve Vice Chair Richard Clarida said on Wednesday the central bank should be in the position to begin raising interest rates in 2023.</p>\n<p>Still, tech and tech-adjacent stocks such as <a href=\"https://laohu8.com/S/NFLX\">Netflix</a> and <a href=\"https://laohu8.com/S/FB\">Facebook</a>, which tend to perform better when interest rates are lower, outperformed the broader market.</p>\n<p>Focus now turns to the Labor Department's monthly jobs report on Friday.</p>\n<p>The Dow Jones Industrial Average fell 323.73 points, or 0.92%, to 34,792.67, the S&P 500 lost 20.49 points, or 0.46%, to 4,402.66 and the Nasdaq Composite added 19.24 points, or 0.13%, to 14,780.53.</p>\n<p>In earnings-related moves, BorgWarner Inc fell even as it beat profit expectations on strong consumer demand for new vehicles, while Kraft Heinz Co tumbled after warning of margin pressure from higher prices of ingredients.</p>\n<p><a href=\"https://laohu8.com/S/HOOD\">Robinhood Markets, Inc.</a> jumped 50.4% as interest from star fund manager Cathie Wood and small-time traders set up the stock for a fourth session of gains after its underwhelming market debut last week.</p>\n<p>Volume on U.S. exchanges was 9.78 billion shares, compared with the 9.71 billion average for the full session over the last 20 trading days.</p>\n<p>Declining issues outnumbered advancing ones on the NYSE by a 2.02-to-1 ratio; Lancz & Associates Inc, an investment advisory firm based in Toledo, Ohio.</p>\n<p>Right after the Fed statement, the S&P 500 index reversed slight declines though it still ended a hair lower on the day.</p>\n<p><a href=\"https://laohu8.com/S/ISBC\">Investors</a> have been worried about how rising inflation and a spike in COVID-19 cases might impact the central bank’s plan to potentially start withdrawing its stimulus.</p>\n<p>The central bank also said that higher inflation remained the result of “transitory factors.” The Fed kept its overnight benchmark interest rate near zero and left unchanged its bond-buying program.</p>\n<p>The <a href=\"https://laohu8.com/S/NDAQ\">Nasdaq</a> ended higher and shares of Google parent <a href=\"https://laohu8.com/S/GOOG\">Alphabet</a> Inc hit an all-time high as a surge in advertising spending helped it post record quarterly results. The stock ended up 3.2%.</p>\n<p>The Dow Jones Industrial Average fell 127.59 points, or 0.36%, to 34,930.93, the S&P 500 lost 0.82 point, or 0.02%, to 4,400.64 and the Nasdaq Composite added 102.01 points, or 0.7%, to 14,762.58.</p>\n<p>The Fed’s statement came at the conclusion of its latest two-day policy meeting.</p>\n<p>“They had a chance to signal they were going to become more hawkish and they chose not to take it. But the celebration came to a crashing halt when Apple Chief Financial Officer Luca Maestri said in a conference call that the company’s revenue growth would slow in the current quarter due to foreign exchange rates, the semiconductor shortage and tougher comparisons with the previous year.</p>\n<p>“We expect very strong double-digit year-over-year revenue growth during the September quarter,” Maestri said, while continuing to avoid exact revenue guidance due to uncertainty related to the COVID-19 pandemic. “We expect revenue growth to be lower than our June quarter year-over-year growth of 36%.”</p>\n<p>Apple’s shares had gained in after-hours trading to that point, but immediately fell back and ultimately ended the extended trading session with a 2% decline.</p>\n<p>Beyond overall revenue, Maestri also warned about one of Apple’s hottest businesses and declined to give any hints about prolonged declines in sales growth.</p>\n<p>“We expect our services growth rate to return to a more typical level,” Maestri said, referring to Apple’s services business, which reached record-high revenue in the quarter by growing 33% to $17.5 billion.</p>\n<p>That growth rate also benefited from a favorable comparison as certain services were significantly impacted by the very beginning of the COVID-19 lockdowns a year ago, he added.</p>\n<p>“We expect significant growth in services, but not to the level that we’ve seen in June,” he said in response to a question about the company’s guidance.</p>\n<p>When asked about the upcoming holiday period, and whether the semiconductor and component shortage would have an impact on what is typically Apple’s biggest quarter, Maestri said he only wanted to talk about one quarter at a time. (Getty Images/iStockphoto)</span></p>\n<p>U.S. investors remain bullish, despite rumblings out of China and the spike in delta variant infections.</p>\n<p>Cloud companies — those at the forefront of the shift in computing power to distributed models over the internet — are expected to grow at a rapid clip over the next several years, and four of the five largest exchange traded funds covering the space are close to hitting record highs.</p>\n<p>Below is a screen of stocks held by those ETFs, showing which are expected to increase their sales the most through 2023. In an industry with many players at relatively early stages, increases in sales, rather than in earnings, might be the best driver of stock prices.</p>\n<p>To begin the screen, we looked at the five largest cloud ETFs:</p>\n<p class=\"t-img-caption\"><img src=\"https://static.tigerbbs.com/36209ce827d95e822cad5128be8b146a\" tg-width=\"933\" tg-height=\"664\" width=\"100%\" height=\"auto\"><span>Source: FactSet</span></p>\n<p>ETFs might be your best way to take a broad approach for a long-term play on the cloud revolution. If you are interested in any ETF, you should review the fund manager’s website.</p>\n<p>Here’s a comparison of total returns through Aug. 4, along with those for the SPDR S&P 500 ETF and the Invesco QQQ Trust (which tracks the Nasdaq-100 Index) for comparison:</p>\n<p class=\"t-img-caption\"><img src=\"https://static.tigerbbs.com/242f135b3c7cca3cbaae3ee574023c1f\" tg-width=\"942\" tg-height=\"577\" width=\"100%\" height=\"auto\"><span>Source: FactSet</span></p>\n<p>The ETFs’ approaches differ. For example, the ARK Next Generation Internet ETF is the only one that is actively managed. The others track an index. It is also the only one that holds shares of Tesla Inc.,which makes up 10.65% of the portfolio, according to information posted by ARK Invest on Aug. 5. Tesla is an electric-vehicle manufacturer, but it can also be considered a cloud company because it distributes software updates over the internet continually, and offers other cloud-based services.</p>\n<p>Another holding unique to ARKW among the five cloud ETFs is Walt Disney Co.,which is certainly an important cloud player through its Disney+ streaming service, even if the company doesn’t say directly how much of its sales are derived from that rapidly growing segment.</p>\n<p>As part of its description of ARKW, FactSet says the following:</p>\n<p><i>“Broadly speaking, the ARKW’s managers appear focused on big buzzwords such as Internet of Things, cloud computing, digital currencies and wearable technology. While the fund’s focus may be appealing for investors with conviction in these new technologies, portfolio implementation is a more difficult task: Most of the companies developing these advancements are huge corporations for which nascent technologies are only a small fraction of total revenues. As such, it’s very difficult to get pure-play access to ARKW’s targeted technologies — so be sure to confirm that the fund’s holdings — not just its thesis — align with your view of the space.”</i></p>\n<p><b>Cloud-stock screen</b></p>\n<p>Together, the five cloud ETFs listed above hold 147 stocks. To project sales growth through 2023, we used calendar 2020 sales estimates as a baseline and then looked at consensus estimates among analysts polled by FactSet for the subsequent three years, if available. (The 2020 numbers are estimates, because many companies’ fiscal years don’t match the calendar.)</p>\n<p>To make sure we had a solid set of estimates, we confined the group to the 126 companies covered by at least five analysts polled by FactSet, for which consensus sales estimates for calendar 2020 through calendar 2023 are available.</p>\n<p>Here are the 20 companies projected to have the highest compound annual growth rates (CAGR) for sales through calendar 2023:</p>\n<p><img src=\"https://static.tigerbbs.com/517a23591cde159fb889ab80abc4bcc6\" tg-width=\"934\" tg-height=\"765\" width=\"100%\" height=\"auto\"><img src=\"https://static.tigerbbs.com/6af2cf5b5f9f0ce50f8f023ac7babc7f\" tg-width=\"935\" tg-height=\"717\" width=\"100%\" height=\"auto\"></p>\n<p class=\"t-img-caption\"><img src=\"https://static.tigerbbs.com/b88ebe72e09cb9ce3294269f0a4ae431\" tg-width=\"935\" tg-height=\"403\" width=\"100%\" height=\"auto\"><span>Source: FactSet</span></p>\n<p>There are actually 21 stocks listed, including Zillow Group Inc.’s Class A and Class C shares.</p>\n<p>It is interesting to see that the list is dominated by stocks held by ARKW. (Getty Images/iStockphoto)\nU.S. investors remain bullish, despite rumblings out of China and the spike in delta variant infections.\nCloud companies — those at the forefront of the shift in computing power to distributed models over the internet — are expected to grow at a rapid clip over the next several years, and four of the five largest exchange traded funds covering the space are close to hitting record highs.\nBelow is a screen of stocks held by those ETFs, showing which are expected to increase their sales the most through 2023. In an industry with many players at relatively early stages, increases in sales, rather than in earnings, might be the best driver of stock prices.\nTo begin the screen, we looked at the five largest cloud ETFs:\nSource: FactSet\nETFs might be your best way to take a broad approach for a long-term play on the cloud revolution. For example, the ARK Next Generation Internet ETF is the only one that is actively managed. The others track an index. It is also the only one that holds shares of Tesla Inc.,which makes up 10.65% of the portfolio, according to information posted by ARK Invest on Aug. 5. Tesla is an electric-vehicle manufacturer, but it can also be considered a cloud company because it distributes software updates over the internet continually, and offers other cloud-based services.\nAnother holding unique to ARKW among the five cloud ETFs is Walt Disney Co.,which is certainly an important cloud player through its Disney+ streaming service, even if the company doesn’t say directly how much of its sales are derived from that rapidly growing segment.\nAs part of its description of ARKW, FactSet says the following:\n“Broadly speaking, the ARKW’s managers appear focused on big buzzwords such as Internet of Things, cloud computing, digital currencies and wearable technology. While the fund’s focus may be appealing for investors with conviction in these new technologies, portfolio implementation is a more difficult task: Most of the companies developing these advancements are huge corporations for which nascent technologies are only a small fraction of total revenues. As such, it’s very difficult to get pure-play access to ARKW’s targeted technologies — so be sure to confirm that the fund’s holdings — not just its thesis — align with your view of the space.”\nCloud-stock screen\nTogether, the five cloud ETFs listed above hold 147 stocks. To project sales growth through 2023, we used calendar 2020 sales estimates as a baseline and then looked at consensus estimates among analysts polled by FactSet for the subsequent three years, if available. PHOTOGRAPHER: MELISSA LYTTLE/BLOOMBERG</span></p>\n<p>It’s become a parlor game in Washington, on Wall Street, and in Silicon Valley to figure out where U.S. Securities and Exchange Commission Chair Gary Gensler stands on cryptocurrencies. Industry lobbyists tune in when he testifies before Congress. Lawyers parse his speeches. Goldman Sachs Group Inc. wealth advisers recently boasted in a research report about looking for clues in 29 hours of the Blockchain and Money course he developed at the Massachusetts Institute of Technology. That’s an arduous but perhaps not novel undertaking, since videos of the classes have garnered millions of views online, something that amazes even Gensler.</p>\n<p>In his first extensive interview about the digital money craze, Gensler signaled that his deep interest in the subject doesn’t mean he’s simpatico with the hands-off oversight approach that many enthusiasts would like to see. Policymakers have struggled with how to respond to the mostly unregulated $1.6 trillion market, which has seen explosive growth and wild price swings. Gensler is contemplating a robust oversight regime, centered on establishing safeguards for the millions of investors who’ve been stocking their portfolios with tokens. “While I’m neutral on the technology, even intrigued—I spent three years teaching it, leaning into it—I’m not neutral about investor protection,” says Gensler, who on Tuesday will give a speech about crypto at the Aspen Security Forum. “If somebody wants to speculate, that’s their choice, but we have a role as a nation to protect those investors against fraud.”</p>\n<p>Gensler has asked Congress to pass a law that could give the agency the legal authority to monitor crypto exchanges, but he says the SEC’s powers are already broad. There’s been much discussion over the years about which kinds of digital assets fall under the SEC’s purview. Some such as Bitcoin that act like currencies are considered commodities, not securities. But there are thousands of other coins, and Gensler believes most are unregistered securities that must comply with SEC rules.</p>\n<p>Broadly he noted that technology has sparked economic progress throughout human history, and he sees a similar boost from digital assets. That may only come, however, with strong and thoughtful regulation. As an analogy, he says the automobile industry didn’t fully take off until governments laid out driving rules. Speed limits and traffic lights provided public safety but also helped cars become mainstream. “It’s only with bringing things inside—and sort of clearly within our public policy goals—that a technology has a chance of broader adoption,” he says.</p>\n<p>Hester Peirce, a Republican commissioner on the SEC known for her advocacy of light-touch regulation of digital assets, says she’s eager to work with Gensler. “A lot people just want more clarity,” she says. “I come from a perspective that people should have the maximum freedom to engage in transactions they want to engage in voluntarily. Society needs to have that discussion about what is the right regulatory framework.”</p>\n<p>Gensler didn’t give a timeline for any SEC action. He has a to-do list that includes 49 non-crypto policy reviews that could slow progress on cryptocurrencies. Many are high-profile and time-consuming efforts, like responding to the GameStop Corp. trading frenzy and the blow-up of the Archegos family office. The SEC is also working to impose new rules that would require companies to disclose carbon emissions and other environmental risks, a Biden administration priority.</p>\n<p>Nor would Gensler comment on the potential for approving a Bitcoin exchange-traded fund, a decision that many in the crypto world are eagerly awaiting, because it would provide an easy on-ramp for investors. A Bitcoin ETF would invest in the cryptocurrency and then trade its shares on the stock market. So far the SEC has balked at permitting such funds, citing concerns about the risk of fraud and manipulation in the Bitcoin market. Gensler has spoken positively about the ETFs during his days at MIT, giving advocates hope that he’s a supporter. Peirce says it’s “high time” the SEC approved a crypto ETF.</p>\n<p>Behind the scenes, Gensler has pushed the agency’s staff members to take a look at an array of potential policy changes. He says there are at least seven SEC initiatives looking at different crypto issues: initial coin offerings, trading venues, lending platforms, decentralized finance, stable value coins, custody, and ETFs and other coin funds. “I’ve asked the staff to use all of our authorities anywhere we can,” he says.</p>\n<p>Gensler says he thinks regulating crypto exchanges is perhaps the easiest way for the government to get a quick handle on digital token trading. But he’s also concerned about new ways people are getting into crypto, such as peer-to-peer lending on so-called decentralized finance, or DeFi, platforms. If firms are advertising a specific interest-rate return on a crypto asset, Gensler says, that could bring the loans under SEC oversight. Platforms that pool digital assets could be seen as akin to mutual funds, potentially allowing the SEC to regulate them.</p>\n<p>Gensler was chair of the Commodity Futures Trading Commission (CFTC) during the Obama administration, where he was responsible for bringing federal oversight to the huge market for derivatives known as swaps after the financial crisis. Patrick McCarty, who teaches a class on cryptocurrencies at Georgetown University’s law school, says Gensler’s understanding of digital assets means he will give the industry a “fair hearing,” though he will likely disappoint many proponents. “When the crypto people say they want legal certainty, they don’t mean that—they want to be unregulated,” McCarty says. “That’s never been Gary’s point of view.”</p>\n<p>Christine Trent Parker, who focuses on crypto assets as a law partner at Reed Smithin New York, says that although new SEC rules would bring more certainty to the industry, they also could divide the policing of the market more starkly—with the CFTC focused on markets linked to virtual currencies such as Bitcoin and the SEC handling much of the rest. “Right now the lines are fuzzy because we have speeches and enforcement and court orders,” instead of bright-line regulation, she says. “If the SEC has sort of a broad framework that pulls in all of the other digital assets, then you have this bifurcated marketplace.” Others have argued that new token developers need some regulatory flexibility to encourage innovation.</p>\n<p>Gensler also sits on the Treasury-led Financial Stability Oversight Council and the President’s Working Group on Financial Markets, which recently held a meeting on the impact of stablecoins. These are crypto tokens that are supposed to be backed by traditional currencies such as the U.S. dollar, and they’ve become a huge part of the crypto trading system. Regulators worry about what could happen if some stablecoin didn’t turn out to be worth what it was supposed to be—prompting an exodus akin to a run on a bank or a money-market fund. Gensler’s views on the panels carry weight, people who follow the issue note, because unlike, say, the Treasury secretary or Federal Reserve chairman, he has real crypto cred.</p>\n<p>His understanding of blockchain and digital assets comes largely from the several years he spent at MIT. Along with creating the cryptocurrency course, he’s been a frequent guest at industry conferences—sometimes speaking 30 to 50 times a year—mixing with deep thinkers and entrepreneurs. He quotes writings of Satoshi Nakamoto, the pseudonymous creator of Bitcoin, from memory and knew some of the core developers of the digital currency.</p>\n<p>The 63-year-old former Goldman Sachs partner traveled an unlikely path to becoming one of the government’s foremost cryptocurrency experts. It started in 2017, when as chief financial officer of Hillary Clinton’s failed presidential campaign he had the lonely job of closing up shop, paying off the final bills, and deciding what to do with the abandoned computers and office supplies. Like many of his shell-shocked former colleagues, Gensler was looking for something to do—and somewhere to sit out Donald Trump’s presidency.</p>\n<p>The answer came from economist Simon Johnson, an MIT professor who encouraged Gensler to come to Cambridge, Mass., and teach. Looking to nurture a long-held interest in the intersection of technology and finance, Gensler jumped at the opportunity. Although he didn’t know much about digital tokens, he connected with people who were part of the university’s burgeoning Digital Currency Initiative and even audited a course in crypto programming. When he suggested MIT teach more about finance and digital money, he was given the job. Industry lobbyists tune in when he testifies before Congress. Lawyers parse his speeches. Goldman Sachs Group Inc. wealth advisers recently boasted in a research report about looking for clues in 29 hours of the Blockchain and Money course he developed at the Massachusetts Institute of Technology. That’s an arduous but perhaps not novel undertaking, since videos of the classes have garnered millions of views online, something that amazes even Gensler.\nIn his first extensive interview about the digital money craze, Gensler signaled that his deep interest in the subject doesn’t mean he’s simpatico with the hands-off oversight approach that many enthusiasts would like to see. Policymakers have struggled with how to respond to the mostly unregulated $1.6 trillion market, which has seen explosive growth and wild price swings. Gensler is contemplating a robust oversight regime, centered on establishing safeguards for the millions of investors who’ve been stocking their portfolios with tokens. “While I’m neutral on the technology, even intrigued—I spent three years teaching it, leaning into it—I’m not neutral about investor protection,” says Gensler, who on Tuesday will give a speech about crypto at the Aspen Security Forum. “If somebody wants to speculate, that’s their choice, but we have a role as a nation to protect those investors against fraud.”\nGensler has asked Congress to pass a law that could give the agency the legal authority to monitor crypto exchanges, but he says the SEC’s powers are already broad. There’s been much discussion over the years about which kinds of digital assets fall under the SEC’s purview. Some such as Bitcoin that act like currencies are considered commodities, not securities. But there are thousands of other coins, and Gensler believes most are unregistered securities that must comply with SEC rules.\nBroadly he noted that technology has sparked economic progress throughout human history, and he sees a similar boost from digital assets. That may only come, however, with strong and thoughtful regulation. As an analogy, he says the automobile industry didn’t fully take off until governments laid out driving rules. Speed limits and traffic lights provided public safety but also helped cars become mainstream. “It’s only with bringing things inside—and sort of clearly within our public policy goals—that a technology has a chance of broader adoption,” he says.\nHester Peirce, a Republican commissioner on the SEC known for her advocacy of light-touch regulation of digital assets, says she’s eager to work with Gensler. “A lot people just want more clarity,” she says. “I come from a perspective that people should have the maximum freedom to engage in transactions they want to engage in voluntarily. Society needs to have that discussion about what is the right regulatory framework.”\nGensler didn’t give a timeline for any SEC action. He has a to-do list that includes 49 non-crypto policy reviews that could slow progress on cryptocurrencies. Many are high-profile and time-consuming efforts, like responding to the GameStop Corp. trading frenzy and the blow-up of the Archegos family office. The SEC is also working to impose new rules that would require companies to disclose carbon emissions and other environmental risks, a Biden administration priority.\nNor would Gensler comment on the potential for approving a Bitcoin exchange-traded fund, a decision that many in the crypto world are eagerly awaiting, because it would provide an easy on-ramp for investors. A Bitcoin ETF would invest in the cryptocurrency and then trade its shares on the stock market. So far the SEC has balked at permitting such funds, citing concerns about the risk of fraud and manipulation in the Bitcoin market. Gensler has spoken positively about the ETFs during his days at MIT, giving advocates hope that he’s a supporter. Peirce says it’s “high time” the SEC approved a crypto ETF.\nBehind the scenes, Gensler has pushed the agency’s staff members to take a look at an array of potential policy changes. He says there are at least seven SEC initiatives looking at different crypto issues: initial coin offerings, trading venues, lending platforms, decentralized finance, stable value coins, custody, and ETFs and other coin funds. “I’ve asked the staff to use all of our authorities anywhere we can,” he says.\nGensler says he thinks regulating crypto exchanges is perhaps the easiest way for the government to get a quick handle on digital token trading. But he’s also concerned about new ways people are getting into crypto, such as peer-to-peer lending on so-called decentralized finance, or DeFi, platforms. If firms are advertising a specific interest-rate return on a crypto asset, Gensler says, that could bring the loans under SEC oversight. Platforms that pool digital assets could be seen as akin to mutual funds, potentially allowing the SEC to regulate them.\nGensler was chair of the Commodity Futures Trading Commission (CFTC) during the Obama administration, where he was responsible for bringing federal oversight to the huge market for derivatives known as swaps after the financial crisis. Patrick McCarty, who teaches a class on cryptocurrencies at Georgetown University’s law school, says Gensler’s understanding of digital assets means he will give the industry a “fair hearing,” though he will likely disappoint many proponents. “When the crypto people say they want legal certainty, they don’t mean that—they want to be unregulated,” McCarty says. “That’s never been Gary’s point of view.”\nChristine Trent Parker, who focuses on crypto assets as a law partner at Reed Smithin New York, says that although new SEC rules would bring more certainty to the industry, they also could divide the policing of the market more starkly—with the CFTC focused on markets linked to virtual currencies such as Bitcoin and the SEC handling much of the rest. “Right now the lines are fuzzy because we have speeches and enforcement and court orders,” instead of bright-line regulation, she says. “If the SEC has sort of a broad framework that pulls in all of the other digital assets, then you have this bifurcated marketplace.” Others have argued that new token developers need some regulatory flexibility to encourage innovation.\nGensler also sits on the Treasury-led Financial Stability Oversight Council and the President’s Working Group on Financial Markets, which recently held a meeting on the impact of stablecoins. These are crypto tokens that are supposed to be backed by traditional currencies such as the U.S. dollar, and they’ve become a huge part of the crypto trading system. Regulators worry about what could happen if some stablecoin didn’t turn out to be worth what it was supposed to be—prompting an exodus akin to a run on a bank or a money-market fund. Gensler’s views on the panels carry weight, people who follow the issue note, because unlike, say, the Treasury secretary or Federal Reserve chairman, he has real crypto cred.\nHis understanding of blockchain and digital assets comes largely from the several years he spent at MIT. Along with creating the cryptocurrency course, he’s been a frequent guest at industry conferences—sometimes speaking 30 to 50 times a year—mixing with deep thinkers and entrepreneurs. He quotes writings of Satoshi Nakamoto, the pseudonymous creator of Bitcoin, from memory and knew some of the core developers of the digital currency.\nThe 63-year-old former Goldman Sachs partner traveled an unlikely path to becoming one of the government’s foremost cryptocurrency experts. It started in 2017, when as chief financial officer of Hillary Clinton’s failed presidential campaign he had the lonely job of closing up shop, paying off the final bills, and deciding what to do with the abandoned computers and office supplies. Like many of his shell-shocked former colleagues, Gensler was looking for something to do—and somewhere to sit out Donald Trump’s presidency.\nThe answer came from economist Simon Johnson, an MIT professor who encouraged Gensler to come to Cambridge, Mass., and teach.
